Terms and Conditions
1. General
'Seller' means the person, Company of Firm offering goods for sale. 'Buyer' means the person, Company or Firm contracting with the seller. 'Order' means the order placed by the buyer for the supply of goods.
2. Acceptance
Acceptance by the seller of any order from the buyer will be subject to the conditions of sale viewable on this site and will assume full knowledge by the buyer of those conditions. No variations of the conditions will be agreed to the seller unless it has been agree in writing,
3. Payment
Payment, unless otherwise stated by the seller, shall be payable by the buyer 30 days from the date of invoice. An Administration charge may be added for overdue invoices.
4. Retention of Title
(a) Goods in any contract shall remain the property of the seller until the buyer has paid for them in full.
(b) At any time the seller may recover from the buyer any unpaid goods as a result of any infringement of the conditions of sale laid down by the seller or if the credit amount outstanding between the parties is in excess of the credit limit that the seller is willing to afford the buyer.
(c) The seller shall (without prejudice to their rights hereunder) be entitled at any time after the due date of payment stated here in before or before such date in the event that serious doubt arises as to the buyers solvency give notice in writing to the buyer to pay within 7 days the full price for the goods under this or any other unpaid contract between the buyer and seller and that if at the end of the 7 day period the biter has failed to pay the whole of the balance outstanding, the seller shall be entitled to immediate re-delivery of goods under this or any other unpaid contract and shall also be entitled to such immediate delivery upon the early appointment of a receiver of the whole or ant part or the buyers unfertakings or passing of a resolution or the making of and order to wind up the buyer for which purpose the seller shall be entitled. The buyer hereby grants to the seller or his agents the license to enter any premises of the buyer during normal business hours for the purpose of removing such goods from the buyers' premises.
5. Fitness for purpose
Goods are not sold for any particular purpose even if implied in the catalogue. No liability is accepted for any direct or indirect costs relating to damage to the property or injury or loss to any person or company or for any loss of profit or production arising from any defect or failure of the goods supplied by the seller.
6. Data
Illustrations, diagrams, line drawings, photographs, weights and measures stated in the catalogue are the statement of opinion and are provided for information only and form no part of the contract. When ordering please ensure the colour of the goods is stated clearly, otherwise a standard stock colour will be issued.
7. Time of Delivery
Time of delivery will be stated on the seller's acknowledgment of order and will commence from that date thereon. The time stated will be an indication only and will not form part of the contract. Delay in delivery will not entitle the buyer to any indemnity penalty or compensation. The seller's obligation to deliver the goods or to meet the delivery date stated in the order acknowledgment will be canceled by circumstances beyond their control such as strikes, floods or any condition of force majeure.
8. Receipt of Goods and Damaged Goods
In the event of any goods being delivered, damaged or short delivered, the delivery docket must be endorsed accordingly and a copy should be sent to the seller immediately. The seller will not accept responsibility for any loss or damage if this condition is not adhered to.
9. Return of Goods
No Goods may be returned after three working days following delivery. Under certain circumstances and provided they are in unused condition, goods may be accepted for return. Normally a 20% handling charge is applicable to authorised returns. Goods manufactured to order cannot be returned. Unauthorised returns will not be accepted.
